
Terms & Conditions
These Terms and Conditions govern the services provided by Gunjan Sharma - Luxyhippie ("we, "us," or "our") to the Client ("you" or "your") in relation to bespoke travel planning, curation, and itinerary services. By engaging our services, you agree to these Terms and Conditions in full.
1. Services
We provide personalized travel planning and curation services based on your preferences, including accommodations, destinations, activities, and any special considerations (e.g., dietary restrictions or health needs). We will make reasonable efforts to accommodate all requests, but certain requests may not always be feasible. Revisions to the itinerary may incur additional fees if the project scope evolves significantly. There is no shipping involved.
2. Payment Terms
Before detailed planning commences, a non-refundable Trip Creation/Curation Fee (TCF) starting at USD 475 (INR 40,000 + GST) per week will be charged following an initial short consultation call. This fee may vary based on the complexity of the trip and will be communicated in advance. For standard travel planning: The TCF will be applicable once the initial consultation call is conducted. For simple hotel bookings (where you already know the accommodation), the TCF may not apply.
2.1 Payment Methods
Payments for the TCF should be made via RTGS/NEFT/wire transfer to the bank account provided or via our online payment link with convenience charge for the intermediary portal. Payment details will be shared with you at the time of invoicing.
2.2 Tax Compliance
All payments must comply with Tax Collected at Source (TCS) regulations and other tax compliance obligations based on your jurisdiction. Failure to remit payments within seven days of the due date may result in the cancellation of services without notice.
3. Payment Structure
TCF will be communicated vide invoice. Other fees for transportation, lodging, etc., are your responsibility. Any post-payment changes to the itinerary may attract additional charges. Multiple iterations may also lead to further service fees.
4. Tax Compliance and Regulatory Obligations
You are responsible for complying with all relevant Tax Collected at Source (TCS) regulations and any other tax laws applicable in your country of residence. This includes ensuring that all remittances comply with local tax laws and reporting requirements. We will not be held liable for any failure to comply with these obligations or any penalties incurred. It is recommended that you consult a tax professional to ensure compliance.
5. Preferred Booking Arrangement
We recommend that all bookings related to your curated itinerary—accommodations, transportation, activities—be made through us for a seamless and high-quality travel experience. While not mandatory, this allows us to manage every element of your trip to the highest standard.
6. Service and Booking Conditions
Our commitment to servicing your itinerary is contingent upon all bookings being made through us. If you make independent bookings, we are not responsible for managing or troubleshooting issues related to those bookings. For independent bookings, we will only provide a high-level itinerary without the detailed servicing and support that we offer when booking through us.
7. Pricing Contingency Based on Availability
All prices for accommodations, transportation, and activities are contingent on availability at the time of booking. Prices may fluctuate due to season, demand, or delays in confirming bookings. You are encouraged to confirm bookings promptly to secure the quoted rates. If there is a delay, any price increases will be communicated to you and borne by you.
8. Your Responsibilities
You are responsible for: Direct payments to third-party vendors (accommodation, transportation, activities). Ensuring your payment options are sufficient to cover costs. Securing all necessary travel documentation (e.g., passports, visas,currency compliance), obtaining comprehensive travel insurance to cover health issues, cancellations, disruptions, and loss of personal belongings. You assume full responsibility for your property and travel safety and acknowledge the inherent risks involved in certain activities.
9. Photography Rights
Any photographs or videos shared with us during or after your trip may be used for promotional purposes on our website or social media platforms, but only with your consent. We do not travel with our Clients and do not photograph them ourselves unless otherwise agreed.
10. Cancellation and Amendments by You
Cancellation policies will vary depending on the services booked. Vendor-specific cancellation policies will be provided with your booking confirmations. If you request changes after payment, any additional costs will be communicated to you before proceeding. Major amendments or multiple iterations may result in additional service fees.
10.1 Refund Policy
There is no refund of the Travel Curation Fee (TCF). All refunds with respect to bookings (whether partial or full) are strictly subject to the refund, amendment, and cancellation policies of the relevant third-party service providers such as hotels, airlines, tour operators, or transportation companies etc. .We do not have independent refund authority and cannot guarantee any refund beyond what such vendors permit under their individual terms. Where refunds are processed, they will be issued only after the relevant vendor confirms receipt and release of funds, and after deduction of any applicable administrative fees, taxes, or third-party charges. In no case shall we be held liable for delays, partial refunds, or denials in refund processing by third-party service providers.
11. Changes or Cancellations by Us or Our Suppliers
Third-party suppliers (e.g., hotels, airlines, tour operators) may amend or cancel services due to unforeseen circumstances. We will notify you promptly of any significant changes and strive to offer alternative solutions. Refunds for third-party cancellations may not always be possible and are entirely dependent on the policies of the relevant third-party service providers such as hotels, airlines, tour operators, or transportation companies etc. . We cannot offer refunds for changes initiated by third-party suppliers, and adjustments will be made to the itinerary at our discretion.
12. Insurance
We highly recommend obtaining comprehensive travel insurance that covers trip cancellation, medical emergencies, and loss of personal belongings. Your insurance should also include coverage for any injuries or accidents that may occur during your trip.
13. Our Responsibilities
We are committed to providing a seamless and personalized travel experience. We will keep you informed throughout the planning process and assist with any issues that arise during your trip.
14. Limitations of Liability
While we take great care in curating your travel, we are not liable for any economic loss, injury, or damage resulting from third-party suppliers or unforeseeable events such as acts of God, war, civil unrest, or travel disruptions. We assume no responsibility for accidents, illnesses, or incidents that occur during the trip.
15. Confidentiality
We agree to maintain strict confidentiality concerning personal information shared during the planning and execution of your trip. All personal data will only be used to facilitate your travel plans.
16. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or legal expenses arising from your actions during the trip. This includes third-party claims resulting from your participation in activities or interactions with service providers.
17. Law & Jurisdiction
These Terms and Conditions will be governed by the laws of India, and any disputes arising out of this agreement will be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. Disputes will be resolved through binding arbitration, following the rules prevailing at the time of the dispute.
